PRIVACY POLICY

This Privacy Policy describes how Av chemists LLC d/b/a AV Chemist (“AV Chemist,” “we,” “our,” or “us”) collects, uses, discloses, and protects personal information through AVChemist.com and related website services.

1. Important HIPAA Notice

This Privacy Policy governs personal information collected in connection with the Site generally.

Some information AV Chemist receives is Protected Health Information (“PHI”) subject to the Health Insurance Portability and Accountability Act (“HIPAA”) and other healthcare privacy laws.

Our HIPAA practices are described in our separate HIPAA Notice of Privacy Practices.

If information is PHI, our HIPAA Notice of Privacy Practices and applicable healthcare privacy laws govern the use and disclosure of that information. If this Privacy Policy conflicts with our HIPAA Notice regarding PHI, the HIPAA Notice controls.

Depending on how you interact with us, we may collect:

Identification and Contact Information

Name, mailing address, delivery address, email address, telephone number, date of birth, and similar identifiers.

Pharmacy and Health-Related Information

Information you voluntarily provide concerning prescriptions, medication names, allergies, health needs, physicians, pharmacies, refill information, prescription numbers, insurance coverage, or related healthcare services.

Some or all of this information may constitute PHI.

Insurance and Claims Information

Insurance carrier information, policy or member information, workers’ compensation information, no-fault information, claim type, claim identifiers, case information, attorney or case-manager details, and information required to coordinate payment or reimbursement.

Communications

Information contained in forms, emails, telephone communications, messages, support requests, or other communications with us.

Delivery Information

Delivery address, delivery preferences, authorized recipients, delivery confirmation, and related logistics.

Account Information

Username, account identifiers, authentication information, settings, and patient-portal activity where applicable.

Device and Internet Information

IP address, browser type, operating system, device identifiers, referring page, pages visited, interaction data, approximate location derived from IP address, and similar technical data.

Cookies and Similar Technologies

Information collected through cookies, pixels, tags, local storage, analytics software, and similar technology, as explained in our Cookie & Tracking Technologies Policy.

  • from another pharmacy;
  • from insurers and pharmacy-benefit organizations;
  • from workers’ compensation or no-fault administrators;
  • from attorneys, case managers, or other persons involved in your claim where authorized;
  • from service providers;
  • automatically through your device or browser; and
  • from other sources permitted by law.

4. How We Use Information

We may use information to:

  • respond to inquiries;
  • process prescription-related requests;
  • establish and maintain patient records;
  • perform prescription transfers and refills;
  • coordinate with healthcare providers;
  • verify insurance or other coverage;
  • process or coordinate claims;
  • arrange medication delivery;
  • provide medication counseling and pharmacy services;
  • maintain patient accounts;
  • communicate about prescriptions and services;
  • provide requested customer support;
  • authenticate users and protect accounts;
  • maintain and secure our website and systems;
  • detect fraud, abuse, and security incidents;
  • analyze website performance;
  • improve our services;
  • comply with pharmacy, healthcare, tax, insurance, legal, and regulatory obligations;
  • establish, exercise, or defend legal rights; and
  • perform other activities disclosed at the time information is collected.

5. How We Disclose Information

Subject to applicable privacy and healthcare laws, we may disclose information to:

Healthcare Providers and Pharmacies

Prescribers, healthcare professionals, hospitals, clinics, previous pharmacies, receiving pharmacies, and other providers involved in treatment or prescription processing.

Health Plans and Claims Organizations

Health insurers, pharmacy benefit managers, workers’ compensation administrators, no-fault insurers, claims administrators, and other payers.

Authorized Attorneys and Case Representatives

Attorneys, case managers, representatives, or other parties involved in a patient's claim when authorized or otherwise permitted by law.

Service Providers

Companies providing hosting, cybersecurity, communications, delivery, analytics, customer support, data storage, payment, technology, or other services.

Where a service provider handles PHI on our behalf and HIPAA requires a Business Associate Agreement, AV Chemist will use an appropriate Business Associate Agreement.

Government and Regulatory Authorities

We may disclose information where required or permitted by law, regulation, subpoena, court order, government request, public-health requirement, healthcare oversight obligation, or pharmacy regulation.

Business Transactions

Information may be transferred as part of a merger, acquisition, financing, restructuring, sale, or transfer of some or all of our business, subject to applicable healthcare privacy requirements.

At Your Direction

We may disclose information when you request, authorize, or direct us to do so.

7. Cookies and Tracking

We may use essential, functional, analytics, and advertising cookies and similar technologies.

Where required by applicable law, we honor qualifying browser-based opt-out preference signals, such as Global Privacy Control.

8. Do Not Track

Some browsers transmit “Do Not Track” signals.

Because there is no single universally accepted technical standard for traditional Do Not Track signals, the Site may not respond to traditional DNT signals.

This does not affect our obligation to recognize legally required opt-out preference signals such as Global Privacy Control where applicable.

9. Data Retention

We retain personal information for the period reasonably necessary to provide services and accomplish the purposes described in this Policy, and as required by pharmacy, healthcare, insurance, tax, record-retention, litigation, and other applicable laws.

10. Security

AV Chemist uses administrative, technical, and physical safeguards designed to protect personal information.

No website, email system, transmission method, or data-storage system can be guaranteed to be completely secure.

Patients should avoid sending highly sensitive medical or prescription information through ordinary email unless instructed to do so and informed of the associated risks.

11. Children

The Site is intended for a general audience and is not directed to children under 18.

Parents, guardians, and authorized representatives may interact with us regarding pharmacy services for minors.

12. U.S. State Privacy Rights

Residents of certain U.S. states may have rights concerning personal information that is not exempt from applicable state privacy laws.

Depending on the state and applicable law, these rights may include:

  • access to personal information;
  • correction;
  • deletion;
  • obtaining a portable copy;
  • learning categories of information collected and disclosed;
  • opting out of sale;
  • opting out of sharing or targeted advertising;
  • limiting certain uses of sensitive personal information;
  • opting out of certain profiling or automated decision-making;
  • appealing a denied privacy request; and
  • receiving equal service and pricing after exercising privacy rights.

Healthcare and PHI exemptions differ by state. Accordingly, a request made under a general state consumer privacy law may not apply to information governed instead by HIPAA or another medical privacy statute.

13. California Privacy Information

This section applies to California residents to the extent applicable California privacy laws govern the relevant information.

AV Chemist may collect the following categories of personal information:

  • identifiers;
  • customer-record information;
  • protected classification information when voluntarily provided or necessary for services;
  • commercial information;
  • internet or electronic-network activity;
  • approximate geolocation;
  • professional or employment information relevant to claims;
  • sensitive personal information, including certain account, identification, health, or precise-location information where applicable; and
  • inferences derived from information described above.

We use these categories for the business and service purposes described in this Policy.

California Requests

California residents may exercise applicable rights using the methods listed in Section 12.

Where required, the Site will honor Global Privacy Control or another legally recognized opt-out preference signal.

We will not unlawfully discriminate against you because you exercise a privacy right.

14. Nevada and Other State Rights

Residents of Nevada and other states may submit requests concerning the sale or processing of covered personal information where applicable.

Submit such requests using the contact methods in Section 12.

15. Third-Party Links

This Policy does not govern websites, patient systems, social-media platforms, or services operated independently by third parties.

Review the privacy policies of those parties when you leave our Site.

16. Changes to This Privacy Policy

We may update this Policy periodically.

We will update the “Last Updated” date and provide additional notice where required by law.
